Effective Date: January 1, 2026

This Terms of Use Agreement (“Agreement”) is a legally binding contract between you (“User” or “you”) and The Handyman App (“The Handyman App,” “we,” “us,” or “our”). It governs your access to and use of The Handyman App mobile application, website, Api’s and related services. By accessing or using The Handyman App, you agree to comply with and be bound by this Agreement. If you do not agree to these terms, you may not access or use The Handyman App.

By using The Handyman App, you agree to:

Legal capacity: You confirm that you are of legal age and capacity under the laws of your country of residence.
Accuracy of information: You will provide true, accurate, current, and complete information during registration or any communication with us.
False information: Providing false, inaccurate, or incomplete information may result in suspension or termination of your account without notice.
Compliance with laws: You will comply with all applicable laws and regulations when using the The Handyman App.
Assumption of risk: You acknowledge that use of the Internet and the The Handyman App is at your own risk.
Security and confidentiality: While The Handyman App strives to maintain security, it cannot guarantee confidentiality of information transmitted over the Internet.
Limitation of responsibility: We are not responsible for:
- The security of data transmitted over the Internet;
- The accuracy of information provided; or
- Any consequences arising from reliance on such information.
Independent assessment: You are solely responsible for evaluating the reliability and suitability of the The Handyman App for your use.

3. Your Account

When creating an account on The Handyman App, you agree to:

Provide and maintain accurate and current information.
Keep your login credentials secure and confidential.
Accept responsibility for all activity conducted under your account.
Notify us immediately at [email protected] of any unauthorized access or suspected security breach.
Understand that your account is personal, non-transferable, and non-assignable.

4. Content and Posting

This section describes your responsibilities and our rights regarding content you submit through The Handyman App.

4.1 Your Content

You may submit text, images, or other materials (“Content”) through The Handyman App. You are solely responsible for all Content you post. Once published, it may not always be removed.

You assume all risks associated with your Content, including reliance by others or disclosure of personal information.

You warrant that you own or have permission to post such Content and that it does not violate any law or third-party rights.

You agree to indemnify The Handyman App against any claims arising from your Content.

4.2 Our Right to Use Your Content

By submitting Content, you grant The Handyman App a non-exclusive, irrevocable, perpetual, worldwide, royalty-free, and transferable license to:

Use, reproduce, modify, distribute, display, and create derivative works of your Content in any media or format, without compensation or notice to you.

You also waive any moral or attribution rights in connection with such Content.

5. Prohibited Content

You agree not to post, upload, transmit, or share any content (“Prohibited Content”) that:

5.1 Violates Laws or Regulations

Contains material that is unlawful, fraudulent, or promotes illegal activity.

Encourages conduct that could constitute a criminal offense or give rise to civil liability.

5.2 Infringes Intellectual Property or Privacy Rights

Infringes or misappropriates copyrights, trademarks, trade secrets, patents, or other proprietary rights of any person or entity.

Violates another person’s privacy, publicity, or data protection rights.

5.3 Contains Harmful, Defamatory, or Abusive Material

Is defamatory, libelous, threatening, harassing, hateful, abusive, obscene, vulgar, or sexually explicit.

Promotes violence, discrimination, or hatred based on race, ethnicity, gender, religion, nationality, disability, or sexual orientation.

Exploits or harms minors in any way.

5.4 Misleading, False, or Deceptive Content

Contains intentionally false, misleading, or deceptive statements or representations.

Impersonates any person or entity, including The Handyman App, its staff, or other users.

Misrepresents your affiliation or relationship with any individual or organization.

5.5 Harmful or Disruptive Content

Contains or transmits viruses, malware, ransomware, worms, or other malicious code.

Interferes with or disrupts the integrity, security, or functionality of The Handyman App or its systems.

Attempts to gain unauthorized access to any user accounts, servers, or networks.

5.6 Commercial or Spam Material

Advertises or promotes goods or services without prior written authorization from The Handyman App.

Includes chain letters, pyramid schemes, spam, or other forms of unsolicited communications.

5.7 Offensive or Inappropriate Use

Circumvents content filters or moderation controls.

Publishes duplicate, repetitive, or irrelevant content to manipulate visibility.

Posts personal or confidential information about others without consent.

6. Reporting Prohibited Content

Responsibility to report: If you believe any content violates this Agreement, you are encouraged to report it promptly.

How to report:

Use the in-app reporting feature (if available); or
Email [email protected] with:
- A description of the content and its location;
- Screenshots or links (if applicable);
- Reason for reporting; and
- Your contact details.

Review process: The Handyman App will review the report in good faith and take appropriate action, including removal of content or account suspension.

No guarantee: While we aim to maintain a safe environment, we cannot guarantee all reported content will be removed.

False reports: Knowingly submitting false or malicious reports may result in account suspension or termination.

7. Intellectual Property Rights

All materials, text, software, graphics, and logos available through The Handyman App are owned by or licensed to The Handyman App and protected under intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use The Handyman App for personal, non-commercial purposes.

You may not copy, reproduce, modify, distribute, or commercially exploit any materials without written consent.

All trademarks, service marks, and logos are the property of The Handyman App or its licensors.

8. Prohibited Conduct

You agree not to:

Use the Application for unlawful purposes.
Attempt unauthorized access to any system, account, or data.
Interfere with or disrupt The Handyman App, including introducing malware or harmful code.
Impersonate others or misrepresent your identity.
Post defamatory, offensive, or infringing content.
Use The Handyman App for unauthorized commercial purposes.
Circumvent security features or collect user data without permission.

Violation of these restrictions may result in immediate termination and potential legal action.

9. Enforcing Security

Unauthorized use or attempted access may result in criminal or civil prosecution under applicable laws, including the Computer Fraud and Abuse Act of 1986.

The Handyman App reserves the unrestricted right to monitor, view, and record user activity without notice.

We may share information with law enforcement agencies as required by law or court order.

We may modify, suspend, or terminate access to the Application at any time for maintenance, security, or operational reasons.

You acknowledge that breaches of this Agreement may cause irreparable harm, and The Handyman App is entitled to seek injunctive relief.

10. Indemnity

You agree to defend, indemnify, and hold harmless The Handyman App, its affiliates, partners, and representatives from all claims, losses, damages, and expenses (including legal fees) arising from:

Your violation of this Agreement;
Any breach of applicable law; or
Your infringement of third-party rights.

The Handyman App reserves the right to assume the defence of any such claim, with your full cooperation.

11. Limitation of Liability

The Handyman App and its affiliates shall not be liable for any indirect, incidental, or consequential damages, including:

Loss of profits or data;
Business interruption;
Unauthorized access or data breaches.

We do not guarantee that the Application will be uninterrupted, secure, or error-free.

Maximum liability: To the extent permitted by law, our total liability shall not exceed the amount you paid (if any) to access the Application.

12. Disclaimer of Warranties

The Application and its contents are provided “as is” and “as available”, without warranties of any kind.

The Handyman App makes no representations or guarantees regarding:

Accuracy, completeness, or reliability of content;
Performance or availability; or
Suitability for any specific purpose.

You use the Application at your own risk.

13. Termination

The Handyman App may suspend or terminate your account or access at any time, without notice, for reasons including:

Violation of this Agreement or applicable law;
Harmful or fraudulent activity; or
Operational or security concerns.

Upon termination, your right to use the Application ends immediately.

Provisions relating to Indemnity, Limitation of Liability, and Intellectual Property survive termination.

14. Governing Law

This Agreement is governed by the laws of the jurisdiction in which The Handyman App operates, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the competent courts of that jurisdiction.

15. Dispute Resolution

You agree to first attempt to resolve disputes through good faith negotiation with The Handyman App.

Disputes must be pursued on an individual basis and not as a class or representative action.

If unresolved, disputes may proceed under the governing law and jurisdiction stated above.

16. Miscellaneous

Entire Agreement: This document constitutes the full and final agreement between you and The Handyman App.
Amendments: We may amend these Terms at any time by posting an updated version. Continued use after changes constitutes acceptance.
Severability: If any clause is deemed invalid, the remaining provisions remain enforceable.
Waiver: Failure to enforce any right does not waive that right.
Assignment: You may not transfer your rights without our consent; we may assign ours freely.
Notices: All communications must be sent to [email protected].
Force Majeure: We are not liable for delays or failures caused by events beyond our control.
Headings: Section titles are for convenience only and do not affect interpretation.
